Divorce & Domestic Relations Order (QDRO)
A Qualified Domestic Relations Order (QDRO) is a U.S. judicial order entered as part of property division in a divorce or legal separation which recognizes retirement benefits as joint marital property. A QDRO awards a portion of the retirement benefits of the participant carpenter who is party to the legal proceedings to an alternate payee. The alternate payee is most often the carpenter’s former spouse but may also be a child or other dependent of the participant carpenter. A QDRO may also be entered for spousal support or child support.
If you are considering divorce or legal separation, your attorney will likely need to construct a QDRO order. The QDRO must be submitted to the Fund Office and will be reviewed to determine if the order is prepared in accordance with Plan procedures. The final QDRO is kept on record by the Fund Office and is the controlling instrument used to allocate your retirement benefits to the alternate payee(s) named in the Order.
